Zyara Products are intended for personal use as directed on the packaging and instructions. Content on the Site, including descriptions, images, videos, testimonials, and articles, is for general informational purposes only.

Nothing on the Site constitutes medical or dental advice, diagnosis, or treatment. Zyara is not a substitute for professional dental care. Consult a licensed dentist or prosthodontist regarding the fit, condition, or replacement of your dentures, and before using any product if you have oral sores, infections, allergies, or other medical conditions.

Discontinue use immediately and consult a professional if you experience irritation, discomfort, an allergic reaction, or any adverse effect. Review the full ingredient list before use.

4. Results Disclaimer

Individual results vary based on factors including degree of bone loss, denture condition, denture age, personal fit, and adherence to instructions. Testimonials and reviews reflect the experiences of individual customers and are not a guarantee that you will achieve the same or similar results.

5. Orders, Pricing, and Availability

All orders are subject to acceptance and availability. We reserve the right to refuse, limit, or cancel any order at our sole discretion, including orders that appear to be placed by resellers, distributors, or through fraudulent means.

We make reasonable efforts to display accurate pricing and product information. If a Product is listed at an incorrect price or with incorrect information due to a typographical or system error, we may cancel any order placed for that Product, even after confirmation, and issue a full refund of any amount charged.

Prices are listed in U.S. dollars and may change at any time without notice. Applicable sales tax is calculated at checkout.

6. Subscriptions and Automatic Renewal

If you enroll in a subscription, you authorize us to charge your payment method on a recurring basis at the frequency and price shown at checkout until you cancel. Your subscription renews automatically unless cancelled before your next billing date.

How to cancel: You may cancel at any time before your next billing date by either (1) logging in to your account and cancelling through the customer portal on tryzyara.com, or (2) emailing support@tryzyara.com with your name, order number, and cancellation request.

Cancellation stops future charges only. Subscription orders that have already been charged are non-refundable. We will notify you of any price change to your subscription before it takes effect.

7. Payment, Chargebacks, and Disputes

You represent that you are authorized to use the payment method you provide. By placing an order, you authorize us to charge the full amount of your order, including applicable taxes.

If you have a billing concern, contact support@tryzyara.com before contacting your bank or payment provider. If a chargeback or payment dispute is filed on an order that was charged and fulfilled in accordance with these Terms, we will contest it and submit supporting documentation, including order records, billing authorization, account activity, IP and device data, communications, and carrier proof of delivery. We reserve the right to suspend accounts and refuse future orders associated with improper chargebacks.

8. Shipping, Risk of Loss, and Title

Products are shipped as described in our Shipping Policy. Risk of loss and title for Products pass to you upon delivery to the carrier. Carrier delivery confirmation, including proof-of-delivery photos, constitutes evidence of delivery.

9. Refunds and Returns

Refunds and returns are governed exclusively by our Refund & Returns Policy, including the 60-Day Money-Back Guarantee and its eligibility requirements. Each refund request is reviewed individually.

10. Authorized Sellers

Zyara Products are sold exclusively through tryzyara.com. We do not authorize any third party to sell our Products. We make no representations, warranties, or guarantees regarding products purchased from unauthorized sellers, and our Money-Back Guarantee does not apply to them.

11. Intellectual Property

All content on the Site, including the Zyara name, logos, trademarks, product names, text, graphics, photographs, videos, designs, packaging, and software, is owned by or licensed to Zyara and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may view and print Site content for your personal, non-commercial use only. You may not copy, reproduce, modify, distribute, republish, display, sell, scrape, or create derivative works from any Site content without our prior written consent.

12. User Content and Reviews

By submitting reviews, photos, videos, comments, or other content (“User Content”), you grant Zyara a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, display, and distribute that User Content, along with your first name and last initial, in any media for any purpose, including marketing.

You represent that your User Content is truthful, reflects your genuine experience, is owned by you, and does not infringe the rights of any third party. We may remove any User Content at our discretion.

13. Prohibited Uses

You agree not to:

Use the Site for any unlawful or fraudulent purpose
Place orders using false information or unauthorized payment methods
Purchase Products for resale without our written authorization
Use bots, scrapers, or automated tools to access or collect data from the Site
Interfere with or disrupt the Site’s security, servers, or networks
Upload viruses, malware, or other harmful code
Impersonate any person or misrepresent your affiliation with any person or entity

14. Disclaimer of Warranties and Limitation of Liability

DISCLAIMER OF WARRANTIES. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, ZYARA AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Some states do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. In those states, our liability is limited to the fullest extent permitted by law.

15. Dispute Resolution, Binding Arbitration, and Class Action Waiver

Informal resolution. Before filing any claim, you agree to contact support@tryzyara.com and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration. Any dispute, claim, or controversy arising from or relating to these Terms, the Site, or any Product that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this provision. The arbitration will take place in the county where you reside or by remote proceedings, and judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. YOU AND ZYARA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU WAIVE YOUR RIGHT TO A JURY TRIAL.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Either party may seek injunctive relief in court to protect intellectual property rights.

Opt-out. You may opt out of this arbitration agreement by emailing support@tryzyara.com within 30 days of your first purchase or account creation, with your name, address, and a clear statement that you opt out of arbitration.

If the class action waiver is found unenforceable, this entire Section 15 will be void, except that the jury trial waiver will remain in effect to the extent permitted by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Zyara and its owners, officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your misuse of the Site or Products, your User Content, or your violation of any law or third-party right.

17. Governing Law and Venue

These Terms are governed by the laws of the State of [State] and applicable federal law, without regard to conflict-of-law principles. Severability. If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign these Terms without our written consent. We may assign our rights and obligations without restriction.

Headings. Section headings are for convenience only and have no legal effect.
